DWI penalties

 The penalties for a DWI conviction are harsh and can have a debilitating impact on your life.

1st offense:

  • Blood Alcohol Content of 0.08 - 0.09 - indefinite loss of driving privileges; mandatory 90-day ignition interlock device; 12 hours of classes at the Intoxicated Drivers Resource Center (IDRC); up to 30 days in jail; fines, surcharges, and assessments in excess of $4000.00.

  • Blood Alcohol Content of 0.10 - 0.14 - indefinite loss of driving privileges; mandatory 7 up to 12 months ignition interlock device; 12 hours of classes at the IDRC; up to 30 days in jail; fines, surcharges, and assessments in excess of $4000.00.

  • Blood Alcohol Content of 0.15 or higher - mandatory 3-month loss of driving privileges; mandatory ignition interlock device during the suspension period and for 9 up to 15 months thereafter; 12 hours of classes at the IDRC; up to 30 days jail; fines, surcharges, and assessments in excess of $4000.00.

  • Refusal-indefinite loss of driving privileges; mandatory 12 months ignition interlock device, 12 hours of classes at the IDRC; fines, surcharges, and assessments in excess of $4000.00.

  • Controlled Substance or Drugs- mandatory 6-month loss of driving privilege; 12 hours of classes at the IDRC; up to 30 days in jail; fines, surcharges, and assessments in excess of $4000.00.

2nd offense:

  • Blood Alcohol Content of 0.08 or higher, or controlled substance - mandatory 1-2-year loss of driving privileges; 12 hours of classes at the IDRC; 2 to 90 days mandatory jail; 30 days community service; mandatory installation of an ignition interlock device during the period of suspension and for 2 to 4 years thereafter; fines, surcharges, and assessments in excess of $4,000.00.

3rd offense:

  • Blood Alcohol Content of 0.08 or higher, or controlled substance - mandatory 8-year loss of driving privileges; 180 days mandatory jail; mandatory installation of an ignition interlock device during the period of suspension and for 2 to 4 years after the suspension period; fines, surcharges, and assessments in excess of $4,000.00.
